Evidence Retention
The Dakota County Sheriff’s Office maintains custody of evidence and property collected during criminal investigations in accordance with Nebraska law and established department policies.
Evidence Retention
All evidence is securely stored and retained based on:
- The type of case (felony, misdemeanor, or civil)
- Court proceedings and legal requirements
- Applicable state laws and statutes
- Department evidence retention policies
Evidence related to active or pending cases will not be released until:
- The case has been fully adjudicated, and
- Authorization for release has been granted by the appropriate authority (court, prosecutor, or investigating officer)
Property Release
Property may be eligible for release when:
- The case is closed or adjudicated
- The item is no longer needed as evidence
- Proper authorization has been received
To request the return of property:
- Contact the Dakota County Sheriff’s Office Evidence Division
- Provide valid identification
- Provide documentation establishing ownership (if applicable)
- Schedule an appointment for pickup
Unclaimed Property
Property that is not claimed within the legally required time frame may be:
- Disposed of in accordance with Nebraska law
- Converted for official use
- Destroyed or auctioned, as permitted
All evidence and property is handled in accordance with Nebraska statutes and court orders. The Dakota County Sheriff’s Office reserves the right to deny release if legal requirements have not been met.

Items That Will Not Be Released
The following items are generally not eligible for return:
- Illegal contraband
- Firearms or weapons prohibited by law
- Evidence ordered forfeited by the court
- Items held for ongoing investigations or appeals
